Binder Contents

Every binder uses the same kinds of folders, so a prosecutor who knows one binder knows them all. The first folders hold the law. The rest hold the office's working documents.

The folders in every binder

Statutes

The sections charged and used most within the case type identified by the binder, each with its official text pulled directly from the legislature's site and checked weekly for changes. Every statute links to its elements and its case law.

Case Law

The controlling decisions, each with its holding in plain English, who won, what the defense argued and how the State uses it. The full opinion is held on the site.

What the Court Must Find

In the reference binders, the findings a judge must make before acting: waiver to adult court, expungement, competency, a search warrant, a sentence reduction and more.

Elements

For each crime, what the State must prove, in order, with the penalty. Each element links back to the statute and forward to the cases that decide it.

Jury Instructions

The pattern instruction numbers for each charge, listed only when a published opinion confirms the number.

Working Documents

The office's own outlines, checklists, motions and plea guidance for that area, such as witness outlines, suppression responses and sentencing arguments. Editors keep them current.
